General Terms and Conditions
Preamble
These general conditions of sale apply to any purchase made by a natural person having the status of consumer on the website https://www.junaejewelry.com , Individual Business, registered in the Nice trade and companies register under number 981 871 056, having its head office located at 10 rue Blacas 06000 Nice, France.
By placing an order on junaejewelry.com, the customer certifies having previously read and accepted the general conditions of sale. Validation of the order thus constitutes formal acceptance of the general conditions of sale.
1.Principle
These general conditions of sale (CGV) which follow define all the contractual relations between the parties. Consequently, the customer is presumed to accept them without any reservation. The purchase of a product on this site implies full and unreserved acceptance of these general conditions of sale by the customer.
These general conditions prevail over any other general conditions not drawn up by Junae Jewelry. They are accessible on the website junaejewelry.com and take precedence, where applicable, over any contrary version or any contradictory document. Junae Jewelry reserves the right to modify these general conditions of sale at any time. However, the general conditions of sale which apply to the order are those accepted by the customer on the date of the order.
2.Product information
Information such as the description, reference and price concerning all items that can be sold via the website are accessible. The main characteristics of the items added to the basket are also recalled on the “Your basket” page.
Junae Jewelry cannot guarantee actual similarity between the product and the website photography due to color variations. However, Junae Jewelry cannot be held responsible for these inconveniences.
3.Order
The customer can first if he does not have one; create a customer account by providing your contact details, email address and password. They will then be able to consult their customer account and access the status of their order. The customer has the possibility of adding items available for sale, subject to availability, to his shopping cart by clicking on the "Add to cart" button.
If the product is unavailable after validation of the order, the customer will be informed. For the order to be considered validated, the customer must accept these general conditions of sale by clicking on the place indicated. Next, the customer will need to select the address and delivery method, then select the payment method. Final validation of the order is established by clicking on “Proceed to payment”.
Once payment has been made by the customer, an order confirmation including all information relating to it will then be sent to the customer by email. It is recommended to check if the confirmation email is not in the spam box.
In certain situations, notably in the event of an incorrect address, non-payment or other problem with the customer's customer account, Junae Jewelry reserves the right to suspend the order until the problem in question is resolved.
4.Price
The price of the items displayed are indicated in euros, taking into account VAT. The price does not include delivery costs and possible customs fees. The sale price of the items will be the only one applicable at the time the order is placed by the customer. Junae Jewelry reserves the right to modify its prices at any time.
5.Payment
To pay for their order, the customer can choose from all the payment methods made available by Junae Jewelry. Upon receipt of your order, standard pre-authorization checks will be performed on your payment card to verify the availability of funds for the transaction. Your card will be debited once your order has been validated. The customer can also choose to pay for their order via PayPal, and in this case, the PayPal account will be debited immediately.
6.Delivery
The products will be delivered to the delivery address specified by the customer when ordering. It is imperative that this information is precise, exact and complete in order to facilitate delivery under normal conditions. Delivery costs will be added to the total price of the order, and their amount will be communicated to the customer before the validation stage of their order. Items are shipped within 3 days. Deliveries are made by post (Colissimo), Chronopost (48-hour delivery) or DHL (outside the European Union).
If delivered outside the European Union, the customer will be responsible for paying customs duties or other taxes imposed upon importation of the products into the destination country. The procedures related to these duties and taxes are also the sole responsibility of the customer. The customer must check the possibilities of importing the products ordered in accordance with the laws and rights of the territory of the country of delivery.
Upon receipt of the product, the customer undertakes to carefully check that the product is complete and in good condition, without any damage. If an anomaly is noted, the customer must contact customer service within three days following the date of receipt of the product.
If the customer is absent on the day of delivery, the delivery person will leave a calling card in the mailbox. This notice will indicate the contact details of the place where the product can be collected and the time allowed to do so. In order to avoid any dispute, the customer must check the conformity of the delivery with the delivery person. If the original packaging is torn or opened, the customer must check the condition of the items. If the items are damaged, the customer must refuse the package and note on the delivery note, in the form of handwritten reservations accompanied by his signature, any anomaly concerning the delivery (open package, damaged item, etc.).
Delivery times are provided as an indication. In the event that delivery times exceed thirty days from the order, the customer has the right to terminate the sales contract and a refund will be made. The customer will receive an email notification to confirm successful receipt by Junae Jewelry of the returned products.
Return costs are exclusively the responsibility of the customer.
Customer wants to return multiple items from the same order, customer must return them together.
7.Refund
The refund will be made via the same payment method used by the customer during their purchase. The refund will be made no later than 3 days following receipt by Junae Jewelry of the returned items. The time frame within which the refund accrues on your card will depend on your bank's practices. Junae Jewelry cannot be held responsible for this delay.
8. Legal Guarantee
The customer has the following legal guarantees for any item purchased on the website:
1. The guarantee of conformity , provided for in articles L. 217-4 to L. 217-13 of the Consumer Code. An item is considered compliant if it is suitable for the intended use, corresponds to the description provided by Junae Jewelry and presents the qualities that the customer can expect taking into account the seller's declarations. In the event of non-compliance of the product upon delivery, the customer has the choice of requesting repair or replacement of the product.
However, Junae Jewelry is not required to follow your choice, if the cost of the chosen solution is disproportionate to the value of the product. If repair or replacement proves impossible, the customer can then choose between restitution of part of the price or termination of the contract, in accordance with article L. 217-10 of the Consumer Code.
However, any defect, breakage, deterioration of the product resulting from incorrect use by the customer cannot give rise to the activation of any of the guarantees. Defects occurring within 24 months following delivery of the product are presumed to be present at the time of delivery unless Junae Jewelry cannot demonstrate that this presumption is not compatible with the nature of the product or the alleged lack of conformity.
2. The guarantee relating to hidden defects in the item sold , provided for in articles 1641 to 1649 of the Civil Code. In the presence of a hidden defect making a product unfit for its use or significantly reducing its usefulness, the customer is entitled to the guarantee of hidden defects of the item sold. In this case, the customer has the choice between returning the product to obtain a full refund, or keeping the product while receiving a partial refund of its price.
9.Intellectual property
All products and elements appearing on the website remaining the property of Junae Jewlery are protected by intellectual property rights. Any illustration, logo, appearing on the articles, accessories, packaging, video, designs and models are the exclusive property of Junae Jewelry. Any partial or total reproduction, total or partial modification of these elements is strictly prohibited.
As part of order processing and customer account management, Junae Jewelry collects and processes the Customer's personal data as well as that of the recipient of the order if different. This data may be used by Junae Jewelry or a partner designated by it to inform it of new products, promotional offers, processing, management and payment of orders.
10. Responsibility
Junae Jewlery cannot be held responsible for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems. Junae Jewlery will not be held liable for indirect damage resulting from any violation of the General Conditions of Sale (CGV).
11. Force Majeure
Junae Jewelry cannot be held responsible in the event of delay or non-compliance with any of the obligations set out in the General Conditions of Sale (CGV) in the event of the occurrence of a case of force majeure, as defined in the Article 1218 of the Civil Code.
The occurrence of such an event results in the suspension of the execution of these general conditions of sale.
12. Applicable law
These general conditions of sale (CGV) are subject to French law. In the event of a dispute arising from these T&Cs and the use of the site, the provisions of these T&Cs will apply in priority.
If the General Terms and Conditions do not contain any relevant provision, French legislation will apply. Any dispute resulting from the relationship with the General Terms and Conditions and use of the site will be submitted to the competent French courts.
